EIA Regulations
Environmental Impact Assessment Regulations

Environmental Impact Assessments are determined by the application of certain listed activities identified in the EIA Regulations.  Until 1 August 2010, Basic Assessments and Scoping and Impact Assessments were conducted under the auspices of Regulations 386 and 387 of the National Environmental Management Act (NEMA, Act 62 of 2008).  On the 2 August 2010 these Regulations were replaced with Regulations 544, 545 and 546. These three Listing Notices prescribe the activities and thresholds that require an Environmental Authorisation in terms of NEMA before they can commence.  The Listing Notices are provided below.

Regulation 546 (Listing Notice 3) - Basic Assessment Process


 

 

The National Environmental Management: Waste Act (NEM:WA, Act 59 of 2008) governs activities related to Waste Management.  Activities listed in terms of Category A and B of this Act require a Waste License before they can commence.
